New York has enacted an updated “move over” law, making it the most recent state to do so.

Governor Kathy Hochul has recently endorsed a new legislation that mandates drivers to change lanes when they encounter any vehicles halted on the side of a highway. This law requires motor vehicle operators to exercise reasonable caution to avoid collisions with vehicles parked, stopped, or standing on the shoulder of a parkway or a controlled-access highway.

The governor’s office states that approximately 300 drivers face roadside accidents resulting in fatalities each year, with 37 individuals being fatally struck outside disabled vehicles in New York from 2016 to 2020.
